Terms and Conditions for Booking Services with Magic School of Bangladesh

1. Introduction These Terms and Conditions ("Agreement") govern the booking and provision of entertainment services ("Services") by Magic School of Bangladesh ("Provider") to the individual or organization ("Client") as detailed in the booking form. By submitting a booking request, the Client agrees to adhere to these terms.

2. Booking Confirmation A booking is considered confirmed only upon receipt of a written confirmation from the Provider after the Client has submitted the booking form and paid the required deposit. The Provider reserves the right to decline any booking at its discretion.

3. Payment Terms

  • Deposit: A non-refundable deposit of 50% of the total fee is required upon booking confirmation.

  • Balance Payment: The remaining balance is due as follows:

    • 50% of the remaining balance must be paid 7 days prior to the event and no later than 1 day after the event.

  • Late Payments: Late payments may incur additional charges at a rate of 10% per week on the outstanding balance.

4. Cancellation and Refunds

  • By Client:

    • Cancellations made more than 30 days before the event will receive a 100% refund of payments made, excluding the non-refundable deposit.

    • Cancellations made within 15 days of the event will not be eligible for a refund.

    • Urgent bookings (events scheduled within 15 days of booking) are non-refundable.

  • By Provider:

    • In the unlikely event that the Provider must cancel, a full refund will be issued, or an alternative performance date will be offered.

5. Client Responsibilities

  • Event Details: The Client must provide accurate event details, including date, time, venue, and audience size.

  • Facilities: The Client is responsible for ensuring that the venue meets the Provider's requirements, including stage area, lighting, sound system, and any other specified needs.

  • Permissions: Obtaining necessary permissions or licenses for the event is the responsibility of the Client.

6. Performance Conditions

  • Environment: The Provider requires a safe and suitable environment to perform. Adverse conditions may result in modification or cancellation of the performance.

  • Schedule: The Provider will adhere to the agreed performance schedule. Any delays not caused by the Provider may result in a shortened performance without fee reduction.

7. Liability

  • Provider Liability: The Provider is insured for public liability. However, liability for any claim arising from the Client’s negligence or the venue’s condition is excluded.

  • Client Liability: The Client assumes responsibility for any loss or damage to the Provider’s equipment caused by the Client or event attendees.

8. Intellectual Property All performance content, including tricks and routines, remains the intellectual property of the Provider. Recording or reproduction of the performance is prohibited without prior written consent.

9. Force Majeure The Provider is not liable for failure to perform due to circumstances beyond their control, including but not limited to natural disasters, illness, or government restrictions.

10. Governing Law This Agreement shall be governed by and construed in accordance with the laws of Bangladesh, without regard to its conflict of law principles. Any disputes shall be resolved under the jurisdiction of Bangladeshi courts.

11. Amendments The Provider reserves the right to amend these terms and conditions. Any changes will be communicated to the Client promptly.

12. Acceptance By proceeding with the booking, the Client acknowledges and accepts these Terms and Conditions.
